Residential Lease Agreement
This Residential Lease Agreement (the “Agreement”) is made and effective as of Start date, by and between Landlord’s name (the “Landlord”) and Tenant’s name (the “Tenant”).
The Landlord agrees to rent to the Tenant, and the Tenant agrees to rent from the Landlord, the residential property described below, on the terms set out in this Agreement. The parties agree as follows:
1. Property
The Landlord leases to the Tenant the residential apartment located at Property address (the “Property”). The Property shall be used solely as a private residence for the Tenant and the Tenant's immediate household.
2. Term
This is a fixed-term tenancy beginning on Start date and ending on End date. Unless the parties agree otherwise in writing, the Tenant shall vacate the Property on or before the end date.
3. Rent
The Tenant shall pay rent of Monthly rent USD per month, due in advance on the 1st of each month, without demand, deduction, or set-off. Rent shall be paid to the Landlord by a method the Landlord reasonably designates.
4. Late Rent
If rent is not paid within five (5) days after its due date, the Tenant shall pay a late fee in an amount permitted by applicable law. Repeated late payment may be treated as a breach of this Agreement.
5. Utilities
Except as otherwise agreed in writing, the Tenant is responsible for arranging and paying for all utilities and services used at the Property.
6. Occupancy and Use
The Property shall be occupied only by the Tenant and the Tenant's immediate household and used only as a private residence. The Tenant shall not use the Property for any unlawful purpose or in a manner that unreasonably disturbs neighbors.
7. Pets
No pets or animals are permitted at the Property without the Landlord's prior written consent, except for assistance or service animals where required by applicable law.
8. Smoking
Smoking is not permitted inside the Property.
9. Maintenance and Repairs
The Landlord shall keep the structure and common systems of the Property in reasonable repair and shall comply with applicable health and safety requirements. The Tenant shall keep the Property clean and sanitary, promptly report needed repairs, and pay for any damage caused by the Tenant or the Tenant's guests beyond normal wear and tear.
10. Alterations
The Tenant shall not make alterations, additions, or improvements to the Property without the Landlord's prior written consent. Any approved alterations become part of the Property unless the parties agree otherwise in writing.
11. Subletting and Assignment
The Tenant shall not sublet the Property or assign this Agreement without the Landlord's prior written consent, which shall not be unreasonably withheld where applicable law so requires.
12. Landlord's Right of Entry
The Landlord may enter the Property to inspect it, make repairs, or show it to prospective tenants or buyers, after giving the Tenant reasonable advance notice as required by applicable law (generally at least 24 hours), except in the case of an emergency.
13. Quiet Enjoyment
So long as the Tenant complies with this Agreement, the Tenant is entitled to quiet enjoyment of the Property.
14. Termination and Default
If the Tenant fails to pay rent or otherwise breaches this Agreement, the Landlord may pursue the remedies available under applicable landlord-tenant law, which may require specific notices and procedures. At the end of the tenancy, the Tenant shall return the Property in clean condition, reasonable wear and tear excepted, remove the Tenant's belongings, and return all keys.
15. Governing Law
This Agreement is governed by the laws of Governing law and by applicable local landlord-tenant law, which may impose requirements that override parts of this Agreement. The parties consent to the jurisdiction of the courts located in Governing law.
16. Entire Agreement
This Agreement, together with any attached rules or inventory, is the entire agreement between the parties regarding the Property and supersedes all prior discussions. It may be amended only by a writing signed by both parties.
If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
This Agreement may be executed in counterparts, including by electronic signature, each of which is deemed an original and all of which together constitute one and the same instrument.
